§ 4  Pharmacies allowances for substances

(1) In the case of the dispensing of a substance which is filled, packaged, packaged or marked in pharmacies in the unaltered state, a fixed surcharge of 100 percent (margin 50 percent) shall be levied on pharmacies’ purchases without turnover tax for substance and required packaging .
(2) The pharmacist’s purchase price shall be based on the quantity of the substance to be dispensed, with the purchase price of the usual packaging being decisive.
(3) If the relevant top – level organization of pharmacists formed for the perception of the economic interests meets the top association of the health insurance funds with regard to the prices of pharmacies to which the calculation is to be based, the fixed surcharge for the duties covered by these agreements is deviating from paragraphs 1 And 2 on these prices. The same applies if social insurance funds, private health insurers or their associations make arrangements with pharmacies or their associations; If such an agreement is not available, the prices agreed pursuant to sentence 1 may be applied.
